TrevorRomain.com Privacy Policy

The Trevor Romain Company is committed to honoring your privacy, including any personal information that might be entrusted to us by you. We support and comply with the Children’s Online Privacy Protection Act (a/k/a “COPPA”), pursuant to which we want to inform the parents/guardians of all children under age 13 regarding the manner that we collect, use and disclose personally identifiable information regarding their children. We also obtain specific permission from the parents/guardians prior to children under age 13 using certain sections of our site or the information being disclosed to any third party.

Information we collect about/from children :

Not all areas of this site result in the collection of information. No information is collected unless the child registers on this site, which occurs in connection with sweepstakes/contests or to participate in a specific game/activity. The only information we collect from children during our registration process is a child’s first name, parent's/guardian’s e-mail address, child’s birth date, member name, and password. We collect birth dates solely to validate the ages of our users. We do not collect any other personally identifiable information from children during our registration process. We also will collect a child’s e-mail address from a parent for the purpose of sending the child e-mail related to a subscription - For instance, Trevor's Newsletter or perhaps a newsletter from Jack or Skye. Under COPPA, we are not allowed to condition a child’s participation in an on-line activity on the provision of more personal information than is reasonably necessary.

We may collect personal information from parents in order for children to participate in certain areas of our site and in connection with our subscription offerings. These features may include the newsletters, Ask Trevor, games and the printable posters areas of the site. While participating in these areas, a child may voluntarily provide us additional information about himself or herself, such as nicknames, favorite colors, etc. If a parent/guardian allows us to collect personal information about their child, we may also link information collected through technology, such as “cookies” (see Terms of Use below).

Our usage and sharing of personally identifiable information that we have collected from/about kids :

When a child registers for a sweepstakes/contest, we e-mail the parent regarding the child’s registration request. To personalize communications to a child regarding a specific product (such as a new item or a personalized message from Jack or Skye), we may use the child’s first name along with the parent’s last name and a mailing address provided by the parent. We may collect a child’s e-mail address from the parent in order to send the child a newsletter, such as discussed above. In addition, personal information regarding a child may be disclosed in the course of a child’s participation in certain interactive features such as "Ask Trevor," games, and the like.

We do not share a child’s personally identifiable information with any third parties unless the disclosure is reasonably necessary to comply with law (e.g., subpoena or other court process); to enforce our Terms of Use, or site or game rules; or to protect the safety and security of our users or this site.

Our notice to and obtaining of consent from parents/guardians for the collection of information from their children :

We e-mail parents/guardians promptly upon their child’s registration for a sweepstakes/ contest, and the parents/guardians have a minimum of 48 hours to refuse consent for their child’s registration. If the parent refuses consent, we delete the child’s information from our database. If the parent/guardian does not respond, consent is deemed denied. Once a parent/guardian allows their child to register, the child will be able to register for additional sweepstakes/contests without any further notice to the parent/guardian. The parents/guardians of a winning child (of a sweepstakes/contest) will be e-mailed and requested to provide their mailing address so that the prize(s) may be delivered. We may publish a winner’s first name, city, and state of residence on this site.

However, parents/guardians may choose to allow the collection and use of personally identifiable information regarding their child, but deny permission for such information to be disclosed to third parties. Prior to a child’s personally identifiable information being disclosed to third parties on the Internet or otherwise, we require a parent’s/guardian’s name and credit card information to verify that such further consent has been given. The credit card will be charged only if the parent/guardian is signing up for a subscription and/or purchasing a product and has authorized the charge on their credit card. In all other instances, the credit card information is used solely for verification purposes as to the parent/guardian granting of permission. The credit card information is archived securely and retained by us as evidence of parental/guardian’s consent.

Parents may change/delete personally identifiable information about their children :

Parents/guardians always have the right to refuse permission and/or recant permission previously given. They may ask that all personally identifiable information previously collected be deleted from our records, in which instance we will promptly comply therewith. The parent/guardian may change and/or delete their child’s personally identifiable information by:

Notice to parents/guardian of any changes to this Privacy Policy :

This Privacy Policy may change periodically, in which event we will notify parents/guardians by e-mail of any material changes in the manner we collect, use and/or share children’s personally identifiable information. Parents should always update their personal information to provide us accurate e-mail addresses. Any changes in this Privacy Policy will comport with COPPA and any other applicable laws or regulations.
